These Terms of Service ("Terms") govern your use of mobile applications developed or published by JGABRIB LTDA ("JGABRIB," "we," "us," or "our").
By downloading, accessing, or using any of our Apps, you agree to these Terms. If you do not agree with these Terms, you should not use our Apps.
1. Use of Our Apps
You may use our Apps for personal, non-commercial purposes, subject to these Terms and applicable laws.
You agree not to:
- Use the Apps for unlawful purposes.
- Use the Apps to develop, distribute, facilitate, test, or assist any form of unauthorized access, hacking, malware, phishing, denial-of-service attacks, security circumvention, or other activities intended to compromise the security, integrity, confidentiality, or availability of any device, network, service, account, or system.
- Attempt to gain unauthorized access to our systems or services.
Modify, reverse engineer, decompile, or otherwise attempt to extract source code from the Apps, except where permitted by applicable law.
- Circumvent security features or technical restrictions.
- Use cheats, exploits, bots, automation, or other unauthorized tools that interfere with the normal operation of an App.
- Interfere with other users' enjoyment of the Apps.
- Attempt to manipulate rankings, scores, rewards, or other game systems through unauthorized means.
We may suspend or terminate access to an App if we reasonably believe that you have violated these Terms or are using the App in a way that may harm the App, other users, or our services.
2. Age Requirements
Our Apps may be used by a mixed audience, including adults and younger users, subject to the applicable age requirements in the country where the App is used.
If you are under the age required to enter into a legally binding agreement in your jurisdiction, you may use the Apps only with the permission and supervision of a parent or legal guardian where required by applicable law.
Parents and legal guardians are responsible for supervising their children's use of our Apps where appropriate.
3. Advertisements
Our Apps may display advertisements provided by third-party advertising networks and other advertising partners.
Advertisements may include banner, interstitial, rewarded, video, or other advertising formats.
Advertisements may be selected or personalized based on information permitted under applicable law and according to the user's privacy choices.
Third-party advertisers and advertising providers may collect and process information according to their own privacy policies. Their practices are also described, where applicable, in our Privacy Policy.
We do not guarantee the accuracy, availability, suitability, or content of third-party advertisements. We are not responsible for products, services, offers, websites, or other content promoted through third-party advertisements.
You should independently evaluate any offer or product advertised before making a purchase or providing personal information to an advertiser.
4. In-App Purchases
Some Apps may offer optional in-app purchases.
Purchases are processed through the applicable app store or payment platform, such as Google Play or the Apple App Store. JGABRIB generally does not directly receive or store your payment card information.
Prices, payment methods, refunds, and purchase management may be subject to the policies of the applicable app store.
5. Game Content and Virtual Items
Some Apps may contain virtual currency, points, rewards, achievements, rankings, items, characters, or other digital content.
These elements are provided for use within the applicable App and do not represent real-world currency or property.
We may modify, replace, suspend, or discontinue virtual items, rewards, features, or other game content where reasonably necessary to operate or improve an App, subject to applicable law.
6. Health and Wellness Disclaimer
Some of our Apps may contain information, exercises, activities, recommendations, calculations, statistics, or other content relating to health, fitness, nutrition, physical activity, or wellness.
This content is provided for general informational and entertainment purposes only and is not medical advice, diagnosis, treatment, or a substitute for professional medical care.
You should consult a qualified healthcare professional before beginning any exercise program, changing your diet, using health-related information from an App, or making decisions regarding your health.
You should not rely on information provided by an App to diagnose, treat, cure, or prevent any medical condition.
Physical activities may involve risks, including injury. You are responsible for determining whether an activity is appropriate for you and for exercising within your own capabilities.
If you experience pain, dizziness, difficulty breathing, or another concerning symptom while performing an activity suggested or displayed by an App, stop the activity and seek appropriate medical assistance.
JGABRIB does not guarantee that health, fitness, nutrition, or wellness information contained in an App is complete, accurate, current, or appropriate for your individual circumstances.
7. Financial Disclaimer
Some of our Apps may contain information, calculations, simulations, statistics, educational material, or other content relating to money, finance, investing, economics, or financial markets.
This content is provided for general informational and entertainment purposes only and does not constitute financial, investment, tax, accounting, or legal advice.
Nothing contained in an App should be interpreted as a recommendation, solicitation, or offer to buy, sell, hold, or invest in any financial product, security, cryptocurrency, asset, or other investment.
Past performance, simulated results, examples, or hypothetical scenarios do not guarantee future results.
Financial decisions involve risk, including the possible loss of some or all of your money. You should conduct your own research and consult an appropriately qualified financial, tax, or legal professional before making financial decisions.
JGABRIB does not guarantee the accuracy, completeness, timeliness, or reliability of financial information, calculations, market data, forecasts, simulations, or other financial content provided through an App.
8. Intellectual Property
All content included in our Apps, including software, graphics, artwork, text, logos, sounds, music, animations, characters, designs, and other materials, is owned by or licensed to JGABRIB and is protected by applicable intellectual property laws.
You receive a limited, non-exclusive, non-transferable, revocable license to use the Apps for their intended purpose.
This license does not transfer ownership of any intellectual property to you.
9. User-Submitted Content
Some of our Apps may allow users to submit, upload, create, store, or otherwise provide content, including text, images, photographs, videos, audio, usernames, comments, or other materials ("User Content").
You are solely responsible for the User Content you submit or make available through an App.
By submitting User Content, you represent and warrant that:
You own the User Content or have all necessary rights, licenses, permissions, and authorizations to use and submit it.
Your User Content does not infringe or violate any copyright, trademark, patent, trade secret, privacy, publicity, or other rights of any person or entity.
Your User Content complies with applicable laws and regulations.
You have obtained any necessary permission from individuals appearing in photographs, videos, or other User Content.
Your User Content does not contain unlawful, fraudulent, defamatory, abusive, or otherwise prohibited material.
You must not submit or upload copyrighted material, trademarks, photographs, videos, music, artwork, or other protected content belonging to another person or entity unless you have the necessary authorization to do so.
By submitting User Content, you grant JGABRIB a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, and use that User Content only as reasonably necessary to operate, maintain, provide, improve, and promote the relevant App, subject to applicable law.
You retain ownership of your User Content.
JGABRIB does not claim ownership of User Content merely because you submit it to an App.
We may remove, restrict, or disable access to User Content that we reasonably believe violates these Terms, applicable law, or the rights of others.
If you submit User Content that infringes another person's intellectual property rights, you may be responsible for any resulting claims, damages, or legal consequences.
JGABRIB is not responsible for User Content submitted by users and does not guarantee that User Content is accurate, lawful, or appropriate.
10. Third-Party Services
Our Apps may integrate with third-party services, including advertising networks, analytics providers, app stores, authentication services, cloud services, and other providers.
Your use of third-party services may also be subject to their respective terms and policies.
We are not responsible for the availability, functionality, accuracy, or practices of third-party services.
11. Updates and Changes
We may release updates, patches, improvements, or changes to our Apps from time to time.
Some updates may be necessary to continue using an App.
We may add, modify, or remove features, content, advertisements, or functionality at any time.
12 Availability
We attempt to keep our Apps available and functioning properly, but we do not guarantee that an App will always be available, uninterrupted, or error-free.
An App may become temporarily unavailable due to maintenance, updates, technical problems, third-party services, network issues, or circumstances beyond our reasonable control.
13. Disclaimer of Warranties
To the maximum extent permitted by applicable law, our Apps are provided on an "as is" and "as available" basis.
We make no warranties regarding the Apps' availability, reliability, accuracy, completeness, or suitability for a particular purpose.
Nothing in these Terms excludes or limits rights or warranties that cannot legally be excluded or limited under applicable law.
14. Limitation of Liability
To the maximum extent permitted by applicable law, JGABRIB will not be responsible for indirect, incidental, consequential, special, or punitive damages arising from or related to your use of our Apps.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
15. App Removal, Discontinuation, and Data Deletion
If an App is removed, suspended, discontinued, or otherwise made unavailable through the Apple App Store, Google Play Store, or another distribution platform, JGABRIB may require users to stop using the App.
If JGABRIB requires the App to be removed from use, users must uninstall and permanently delete the App and any associated App data stored on their devices, including locally stored files, downloaded content, cached data, and, where technically possible, copies of the App or its data contained in device or cloud backups.
Users must not attempt to reinstall, redistribute, modify, or continue using an App that JGABRIB has expressly required users to discontinue, except where such restriction is prohibited by applicable law.
JGABRIB may also discontinue related online services, servers, features, or functionality associated with the App. We are not responsible for loss of User Content, game progress, virtual items, or other data resulting from the discontinuation of an App, except where otherwise required by applicable law.
16. Termination
You may stop using an App at any time by uninstalling it from your device.
We may suspend or terminate access to an App if you violate these Terms
Upon termination, provisions that by their nature should continue to apply will remain effective, including provisions concerning intellectual property, disclaimers, and limitations of liability.
17. Changes to These Terms
We may update these Terms from time to time.
When we make changes, we will update the "Last Updated" date at the top of this document.
Your continued use of our Apps after updated Terms become effective constitutes acceptance of the revised Terms, where permitted by applicable law.
18. Governing Law
These Terms shall be governed by the applicable laws of Brazil, without regard to conflict-of-law principles, except where applicable consumer protection or other mandatory laws provide otherwise.
